Notice of the Supreme People's Court on Strictly Implementing Laws, Regulations and Judicial Interpretations and Legally and Properly Handling Cases Concerning Expropriation, Demolition and Relocation

The higher people's courts of all provinces, autonomous regions, and municipalities directly under the Central Government; and the Production and Construction Corps Branch of the Higher People's Court of Xinjiang Uygur Autonomous Region:
Since the formulation and implementation of the Administrative Compulsion Law of the People's Republic of China (hereinafter referred to as the “Administrative Compulsion Law”), the Regulation on the Expropriation of Buildings on State-Owned Land and Compensation (hereinafter referred to as the “Regulation”) and the Provisions of the Supreme People's Court on Several Issues Concerning the Handling of Cases for Application to the People's Courts for Compulsory Enforcement of Decisions on Compensation for Expropriation of Buildings on State-Owned Land (hereinafter referred to as the “Provisions”), the expropriation, demolition and relocation in a legal, civilized, and harmonious manner has been extensively recognized by the public. However, from this spring, malignant incidents of illegal expropriation, demolition and relocation have occurred occasionally in some regions, and have been on the rise. For purposes of preventing and containing the recurrence of similar incidents and creating a favorable social environment for the successful holding of the 18th National Congress of the Communist Party of China, the relevant issues are hereby notified as follows:
I. Strengthening the study and training of the relevant laws, regulations, and judicial interpretations.
